BOAT RENTAL LIABILITY WAIVER AND AGREEMENT

This Boat Rental Liability Waiver and Agreement ("Agreement") is made and entered between:

Boat Rental Company: [Little Lady Boat Co./ LLC] ("Owner") & Renter

1. ACKNOWLEDGMENT OF RISKS 

Renter understands and acknowledges that operating or riding in a boat involves inherent risks, including but not limited to:

  • Drowning, injury, or death
  • Damage to the boat or personal property
  • Collision with other boats, objects, or persons
  • Weather-related hazards
  • Mechanical failures or malfunctions

Renter voluntarily assumes all risks associated with the use of the rental boat.

2. RELEASE OF LIABILITY AND INDEMNIFICATION 

Renter agrees to release, waive, and discharge [Little Lady Boat Co.], its owners, employees, agents, and affiliates ("Released Parties") from any and all claims, liabilities, damages, losses, or causes of action arising from the rental or use of the boat and rented equipment, including those caused by the negligence of the Released Parties.

Renter further agrees to indemnify and hold harmless the Released Parties from any claims, demands, or lawsuits brought by third parties as a result of Renter’s use of the boat.

3. RENTAL TERMS AND CONDITIONS

  • Renter must be at least 21 years of age and possess a valid government-issued ID.
  • Renter must comply with all local, state, and federal boating laws and regulations.
  • Renter must not operate the boat under the influence of drugs or alcohol.
  • Rental does not begin until date and time signed on the rental agreement; This includes if the boat rental is dropped off early due to schedule conflicts with Little Lady Boat Co. and or renter.
  • Renter must not operate the boat after legal sunset time or before legal sunrise time.
  • Renter is responsible for all damages to the boat, equipment, or any third party property.
  • Life jackets must be worn by all passengers at all times as required by law.
  • Renter agrees to return the boat in the same condition as received.
  • Renter agrees to return all rented equipment in the same condition as it was received. 

4. INSURANCE AND DAMAGE RESPONSIBILITY 

Renter understands that any damage to the boat, equipment, or third-party property is the sole responsibility of the Renter. Renter agrees to cover all repair or replacement costs and authorizes [Little Lady Boat Co.] to charge the provided payment method for such costs. Renter agrees to pay any and all legal costs incurred by [Little Lady Boat Co.], its owners, employees, agents, and affiliates ("Released Parties"). 

5. EMERGENCY PROCEDURES 

In the event of an emergency, accident, or mechanical failure, Renter must:

  • Call 911 for medical emergencies.
  • Contact [Little Lady Boat Co.] immediately at [410-924-8846].
  • Remain with the boat unless instructed otherwise by authorities.
  • Call Tow Boat US [410- 745-3000] for towing

6. GOVERNING LAW 

This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland.

7. SEVERABILITY 

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

8. ACKNOWLEDGMENT AND ACCEPTANCE 

By booking with us, you acknowledge that you have read, understand this agreement, accept its terms, and voluntarily assume all risks associated with the rental and operation of the boat.
